Terms of Service
1) Who we are
“Valera Custom Prints” (“we”, “us”, “our”) provides custom 3D printing, prototyping, and small-batch part fabrication services (“Services”). By contacting us, requesting a quote, submitting files, placing an order, or using this website, you agree to these Terms.
2) Quotes, scope, and approvals
- Quotes are estimates based on the information you provide (files, dimensions, material, quantity, finish, and timeline).
- Scope changes (design edits, new tolerances, different materials, higher quantities) may change price and lead time.
- Approvals: we may send photos, measurements, or notes for approval (“proof-before-print”). Once you approve, we proceed with production.
3) Customer responsibilities
- You represent that you have the rights to provide any files, logos, models, text, or designs you submit.
- You are responsible for confirming critical requirements (fit, clearances, load, heat exposure, outdoor use, cosmetic expectations).
- If you provide measurements or specs, you are responsible for their accuracy.
4) Intellectual property (IP) and licenses
- Your IP: you retain ownership of your original designs and content you submit.
- License to produce: you grant us a limited, non-exclusive license to use submitted files only to evaluate, quote, and manufacture your requested parts, and to communicate about the project.
- Our know-how: we retain rights to our internal manufacturing processes, profiles, tooling concepts, and production methods.
- Showcase: unless you explicitly ask us not to, you grant us permission to display non-confidential photos of the finished prints for portfolio/marketing purposes (no sensitive dimensions or files). You can opt out anytime by emailing us.
5) Materials, tolerances, and variation
3D printing is a manufacturing process with inherent variation. Layer lines, minor surface marks, and slight dimensional variance are normal. Exact cosmetic perfection (or exact match to injection-molded finishes) is not guaranteed unless explicitly stated in writing.
- Tolerances depend on geometry, material, and print orientation; we can discuss tolerance targets for fit-critical parts.
- Color can vary between filament batches and between screens/photos.
- Strength depends on material choice, wall thickness, infill, orientation, and use-case; tell us load/heat requirements up front.
6) Pricing, payment, and taxes
- Payment terms are communicated during quoting/invoicing and may require a deposit or full prepayment for custom work.
- Prices do not include shipping unless stated.
- You are responsible for applicable taxes, duties, or import fees if relevant.
7) Lead times, shipping, and risk of loss
- Lead times are estimates and depend on workload, material availability, and project complexity.
- If shipping is used, risk of loss transfers to you upon carrier acceptance unless otherwise required by law.
- We are not responsible for carrier delays, loss, or damage, but we will reasonably assist with claims when possible.
8) Cancellations and refunds
- Custom-made items are generally non-refundable once production has started.
- If you cancel before production starts, we may refund amounts paid minus any non-recoverable time/material costs already incurred.
- If you cancel after production begins, you are responsible for work completed and materials used.
9) Returns and reprints
If there is a clear manufacturing defect relative to the agreed written spec (wrong material, wrong quantity, major deviation from confirmed dimensions), contact us within 7 days of delivery. We may, at our option, reprint, repair, or refund the affected portion.
- We are not responsible for issues caused by incorrect customer-provided files/specs, or use outside intended conditions.
- Normal print artifacts and minor cosmetic imperfections are not defects unless explicitly covered in writing.
10) Prohibited use
You agree not to request or use our Services to produce unlawful items or items that infringe third-party rights. We reserve the right to refuse service for any request at our discretion.
11) Disclaimer of warranties
Services and prints are provided “as is” and “as available,” without warranties of any kind, except as explicitly stated in writing. You are responsible for verifying suitability for your use-case.
12) Limitation of liability
To the maximum extent permitted by law, Valera Custom Prints will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue, arising from your use of our Services or prints. Our total liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.
13) Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising from your submitted designs/files, your misuse of the prints, or your violation of these Terms (including IP infringement claims relating to your content).
14) Disputes
If a dispute arises, contact us first so we can try to resolve it quickly. If unresolved, disputes will be handled under applicable law in a competent court, unless a different method is required by law.
15) Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the current version. Continued use of the site or Services after changes means you accept the updated Terms.
